President Jamaica Bay Homeowners Assoication, Inc.

Hi, I'm Richard Kulpa and I am the President of the Jamaica Bay Homeowners' Association of Lee County, Inc..

Our community, Jamaica Bay, is a gated community located in Ft. Myers, Florida. www.JamaicaBay.com  We have 1417 resident owned manufactured homes but we rent the lots our homes occupy. Approximately 2200 residents live in Jamaica Bay and about half of our residents are snowbirds or part-time residents.

We are a 55 plus community and our homeowners' association falls under the administrative guidelines of Florida Statute 723 which governs the way we conduct the business of the association.

Administratively, we have a Board of Directors that includes fourteen community zone directors, two at-large directors and a President, Vice-President, Secretary and Treasurer. We are a not for profit corporation and have a 501 (c) 4 tax status. Our board has several standing committees that include Negotiating Committee, Nominating Committee, Election Committee and others appointed by the President on an as needed basis. All of our officers and board members are elected to their positions by the residents of the community who are members of the association. Membership in the association is attained by paying a fully refundable $100 one time membership fee. The membership provides one vote per household on all matters requiring a vote. Non members do not vote but all residents of the community are welcome at our meetings and are represented by the association.

Our sole function is to represent the needs of the homeowners' and negotiate with management important decisions involving rent increases, changes in rules and regulations and reduction in services and utilities. Florida Statute 723 sets the guidelines for management and the association to meet and bargain in good faith concerning these three areas. In addition, management and the association President meet on a regular basis to discuss the overall operation of the community.

The homeowners' association (HOA's) have a fiduciary responsibility to all homeowners. They act as a guardian, morally bound to support and defend the homeowners. An HOA is not a social club. It is a legal management entity representing all homeowners. The HOA must insure that every homeowner is knowledgeable of their park owner's rights and the rights and privileges of themselves. The HOA encourages every homeowner to have their own copy of Florida Statute 723 and a copy of the community Covenants.

Homeowners' should always maintain membership in the HOA, in both good times and bad times. If you choose not to be a member in good standing then you are allowing the HOA board to make decisions affecting you without any input from you. The HOA's duty is to investigate, intervene and represent any homeowner in conflict with the community management. Community management does not manage or dictate operations of the HOA. The HOA, as a legal entity, has numerous powers and protections for homeowners.

There are many social and recreational opportunities in our community. They are under the direction of the Jamaica Bay Club. A monthly magazine, The Jamaican, is published and it includes a calendar of events and many articles about the activities. It is a must have if you wish to stay informed and active.

Your Jamaica Bay Homeowners' Association is constantly working for the betterment of our community.
